Tejpal arrest possible only after the victim deposes in the court

Goa police will be able to arrest Tehelka Editor-in-Chief Tarun Tejpal in an attempt to rape case only after they manage to get the victim girl deposed before the court, establishing the fact.
A team, headed by a DySP, is leaving for the national capital tomorrow to gather all the possible evidence after the crime branch of Goa police filed the First Information Report against Tejpal.
The crime branch has filed the FIR against Tejpal for attempting to rape his junior colleague in Goa during the THiNK Fest held two weeks ago and also for outraging her modesty.
Tejpal allegedly attempted to rape the victim girl twice, on two days subsequently, in the elevators (lifts) of Hyatt Resorts at Bambolim, where the THiNK Fest was happening.
Highly placed sources at the police headquarters however disclosed to goanews.com that the lifts, unfortunately, have no CCTV installed inside.
The police have to thus reply upon the CCTV footage in the lobbies where some movement could be seen, either while getting entering the elevators or getting out.
“This would at the most help us as circumstantial evidence”, said the police sources.
The police have already sought the whole CCTV footage and it is still being verified, DIG O P Mishra told the media persons today.
Hyatt Resorts has around 140 CCTVs installed at different places, but not in the elevators.
The FIR however has been filed based on media reports as well as the unauthenticated soft copy of the email, written by the victim girl to Shoma Chaudhury, the managing editor of Tehelka.
“Let the concerned officials investigate the facts and arrive at a conclusion”, Mishra said, while refusing to divulge any further information.
The police team that is leaving for Delhi tomorrow would probably focus mainly upon registering the statement of the victim girl.
As per the fresh amendment made to the Criminal Procedure Code, the victim girl in sexual assault case has to depose before the Judicial Magistrate First Class.
In this case, the girl will have to depose either at the JMFC in Delhi or in Goa, said police sources.
The investigating team would also try and meet the Tehelka staffers, whom the victim girl had narrated both the incidents in Goa.
The team would also interrogate Tejpal.
Though it is being rumoured that Goa police would now arrest Tejpal tomorrow itself, sources at the Goa police headquarters disclosed to goanews.com that the decision in this regard would be taken only after the girl deposes.
