Accused of abusing a minor girl, Remo calls the charge fabricated

Goa’s internationally renowned pop singer Remo Fernandes is accused of abusing a minor girl, who was knocked down by his son driving a car. Remo however has flatly denied the allegation, calling it fabricated.
Goa police have booked a case against Remo under Goa Children’s Act for verbally abusing the injured minor girl at Goa Medical College hospital, where she is being treated with two surgeries.
His son Jonah, on the other hand, is charged under sections of IPC for rash and negligent driving causing grievous injury.
Allen D’Souza, the 17-year old girl from Malwan, Sindhudurg of Konkan region of Maharashtra, was on a walking pilgrimage along with her family on 1 December for the Old Goa feast.
She was knocked down at Guirim on Mapusa-Panaji road by a car, which was driven by 26-year old Jonah while Remo was sitting in the pillion when the incident took place.
The blood-stained Allen was rushed to the Mapusa district hospital by 108 ambulance and later transferred to GMC hospital, where she was operated twice, her fractured ankle and the skin graft.
According to North Goa SP Umesh Gaonkar, the offence however was registered only on 15 December, when Allen’s sister filed a complaint at Mapusa police station.
He also said Remo and the victim’s family were in the process of reaching a compromise, due to which perhaps a formal police complaint was delayed.
The Goan, a newspaper, reports that the victim’s family declined Remo’s offer to pay them Rs 50,000 towards compensation.
AIRES CHARGES REMO
Aires Rodrigues, a lawyer-cum-activist, has however filed another complaint against Remo at Agacaim police station yesterday, alleging that Remo verbally abused the minor victim in the GMC hospital.
Remo, who has been advised to refrain from coming out with a rebuttal at this stage, said the accusations are all false, a total distortion and fabrication of the facts.
“I would rather let the law take its course”, the pop singer told goanews.com.
Adv Rodrigues posted on WhatsApp that Remo told the victim girl: “why are you alive, you should have died.”

“I do reserve the liberty to initiate appropriate proceedings, both before the Civil and Criminal Forums, against all individuals and specifically against Aires Rodrigues, for the material alleged against me and my son, which has clear defamatory overtones," said Remo.
SP Gaonkar said the police would first record the statements of the victim and their family members and then summon Remo to record his statements.
While expressing total ignorance over what Remo said, the police officer also said the offence becomes more serious when a person dies in an accident, almost equivalent to murder, though not intentional.
OFFENCES
The police have registered an offence against Remo’s son Jonah under sections 279 and 338 of Indian Penal Code.
Section 279 provides for a punishment of six month imprisonment or/and a fine of Rs 1000 for rash or negligent driving, causing hurt or injury to another person.
Section 338 applies to causing grievous hurt by act of endangering life or personal safety of others with a punishment for two years and/or a fine of Rs 1000.
In case of death, police add section 304 (A) of IPC, meant for causing death by negligence amounting to culpable homicide, punishable with imprisonment of two years and fine.
The Agacaim police have registered an offence against Remo under Section 8 r/w 2(m), which primarily deals with abusing a child in any manner, psychologically or physically.
