Tejpal summoned by Goa police tomorrow; will he be arrested?

Goa police have summoned Tehelka founder editor Tarun Tejpal to appear before the crime branch by 3 pm tomorrow. But will Tejpal appear when the Delhi high court is delivering order on his bail plea on 29 November?
Secondly, can Goa police arrest Tejpal, pending Delhi high court decision day after tomorrow?
“I cannot tell you even the legal position; you better consult a lawyer in this regard”, DIG O P Mishra advised the media persons today.
One thing is certain that Tejpal would not be arrested today since the statement of the victim girl, whom Tejpal believed to have raped in Goa early this month, was being recorded before Panaji JMFC till late evening.
Though the order on his bail plea has been postponed till Friday, the Delhi high court also refused to grant him immediate relief.
Tejpal had requested the court to grant him transit bail, till he approaches the Goa court seeking anticipatory bail.
“In such a situation, the police can definitely arrest Tejpal since there are no orders not to arrest him”, said Adv Cleofato Almeida Coutinho, a constitutional lawyer.
However, he also said it all depends on how Goa police plans its strategy.
As the police have already summoned him to Goa by 3 pm tomorrow, Coutinho felt that the police may not take a step to arrest him at least till tomorrow afternoon.
Goa police have intimated Tejpal through all possible means - through Delhi police, Delhi Commissioner of Goa Sadan, email as well as sms on his mobile phones.
“Why will the police arrest him when he has already been summoned”, argued chief minister Manohar Parrikar, while also making it clear that he is not suggesting to the police what they should do.
It also needs to be seen whether Goa police will trouble the Delhi police to arrest Tejpal or a special team would go to the national capital once again to arrest Tejpal.
Sources in the police headquarters said a strategy is yet to be planned since the victim girl’s deposition was not over till late evening.
However, it is now certain that Tejpal cannot avoid the arrest if the high court dismisses his bail application on 29 November.
If the transit bail is granted, Tejpal would once again move to the Goa court, seeking anticipatory bail.
Even if it is granted, Tejpal has to be ‘technically’ arrested, though may not be locked up in the police or judicial custody.
The only issue is that when Tejpal would be arrested, tomorrow after 3 pm or day after tomorrow after the court delivers order on his bail plea.
