Police filed rape case without examining victim: Parrikar

Chief minister Manohar Parrikar feels the case of a rape on a minor, involving the then minister’s son, is worth probing into why the case was filed when the German victim girl was not even examined to establish the rape.

During a discussion in the Assembly, he was referring to the case of then education minister Babush Monseratte’s son Rohit, who was later acquitted of rape charges.

The case number 145/2008 at Calangute police station he referred to was filed against Rohit in February 2008 while he was acquitted on 6 July 2011.

In his written reply, Parrikar said he was acquitted as there was “no sufficient evidence brought on record and victim girl not examined while the complainant (the mother) was not available for cross examination’.

“I really don’t know who sabotaged the case – the police, the famous lawyer representing the accused or the parents (did not mention whose)”, said Parrikar.

The chief minister in fact fully agreed with the argument of MGP MLA Lavoo Mamledar, the retired police officer, that examining the victim and establishing the rape through medical examination is a must before filing a rape case.

“I really cannot understand why the German victim girl was not examined”, he said.

The case did not stand in the court as the victim girl as well as her mother wrote to the Children’s Court that they did not want to pursue the matter further.

Parrikar informed the case was filed as per the high court order while it was argued by one famous lawyer.

India’s famous criminal lawyer Ram Jethmalani was arguing for Rohit Monseratte in this case.

Parrikar also informed the House that most of the rape cases were ending into acquittal since both the accused and the victim, in most of the cases, tell the court that either they are married or the sexual act was with consent.

Are Goa Police so dumb? BTW, what is police suppose to examine, as reported above. Aren't they suppose to get a medico examine the poor victim, first thing.

They filled a rape report without a medical report or they were made to file a report without a medical report confirming rape. And Monsarette brought Jethmalani to defend the crime!
