CM assures to intervene in Desmond suspension case

Lawyers assembled outside CM's bungalow

Chief Minister Digambar Kamat has assured to intervene into the burning issue of suspension of judge Desmond D’Costa.

He assured the striking lawyers to convey their demands to the chief justice of Bombay high court, when the lawyers called on his today afternoon.

The striking lawyers have demanded that the suspension of judge D’Costa be immediately revoked.

They have also demanded that Principal District and Sessions Judge of South Goa Utkarsh Bakre explain the content of the complaint against judge D’Costa, the district and additional sessions judge of South Goa.

The striking lawyers have also submitted similar memorandums to Justice S B Deshmukh and registrar I K Jain.

They have also assured the striking lawyers to convey their demands to the chief justice.

Meanwhile, the boycott of lawyers of the court proceedings spread to almost eight out of total 11 courts all over Goa.

The lawyers of Margao, Quepem and Vasco continued their boycott for the second consecutive day.

Lawyers of Canacona, Sanguem, Mapusa and Pernem joined the boycott today.

Panaji lawyers later in the evening joined the stir by boycotting the proceedings.

Ponda lawyers met in the evening and decided to boycott on Monday.

Bicholim and Valpoi lawyers however have not yet responded to the state-wide stir.

The South Goa lawyers however have decided not to enter the court room of judge Bakre until judge Desmond is reinstated.

Transparency is a must so that the common man knows as to what is the crime and what is the punishment.

In absence of transparency one will always suspect that something fishy is going on behind the closed doors. The history of Independent India has shown that when the doors are closed --lot many unwanted things are being carried out. It is only because of the RTI act that now the common man is getting aware of the serious things being carried out-- behind closed doors. In a vibrant democracy there is no justification for continuation of closed door actions --all under the nice guise of confidentiality...............

Judiciary in India is in crisis. A judge has been imeached in Calcutta, allahabad high court has been heavily criticised for corruption by Supreme court, A lawyer of ShantiBhushan's calibre has claimed in open court that eight out of sixteen retired CJs of the Suprememc court have been corrupt.

What happens in goa? A highly respected, incredibly gifted, upright and incorruptible gentleman, Desond D'costa is supsended. It is high time the High court stops hiding behind the usual terms such as confidentiality and explain to goan people how this has come about. If there is good reason, we need to know. If there isn't, Desmond should be immediately re-instated to his rightful place and the people who have indulged in this unholy act should be made to pay a price.

There is also another pending case of Anuja PrabhuDesai who by all accounts was someone who has shown integrity and professionalism in her work. She should also be re-instated urgently.

These acts of suspension of two bright Goan judges will leave a stain on the Judiciary unless immediate remedail actions are taken. I urge the Chief Justice of the Goa High court to act.

This is disgraceful, when lawyer fraternity have to take to the streets. A judge makes a complaint against a fellow judge in the hierarchy, and the latter is suspended, without even knowing the concrete reasons. I am sure when he is eventually re-instated, the smudge and the scars on his once impeccable career will remain indelible. In the eyes of the public even a criminal is read his or her rights, but in this case the victim is by no means a criminal, but one who meted out justice even to the criminals. Perhaps, a memo or a reprimand would have sufficed? I cannot question that. Someone who is lauded by those who know him, for his integrity and forthrightness, how can he be placed in the dock ?

On the sidelines, what came into the limelight, is the question as to why a High Court of Goa, Daman & Diu and Dadra and Nagar Haveli, is not established for Goa, instead of the Bench under the Bombay High Court ever since 1987 when Statehood was conferred. Since then Goa has grown into a vibrant State with its own complexities. The whole nation is crying out for speedy justice, and steps such as the above occurrence is retrogade. We need to go forward and regain confidence in the three branches of governance viz. the legislature, the executive and the judiciary. It is not only sufficient to make laws but the justice under the law has to be delivered.

Good to see the Lawyers taking up the case of injustice against the Hon. Judge who command public respect for his integrity, probity, unbiased and straight forward way of working. The common man feels totally dismayed at such incidents where he suspects victimisation of honest Officials--as is happening everywhere in the Country...Let the system not victimise the honesty self esteem and probity in public life..........
